A man committed crime for pouring ink on Mao Zedong’s picture

To attract attentions, a 42-year-old man named Sun Bing dared to pour a bottle of ink to Mao Zedong’s picture in Tiananmen Gatetower. As a result,the picture is ruined by the ink. Sun Bing was sentenced to a year and two months for committing affray crime by Dongcheng Court,according to the journalist from Legal Evening News.

为了引人关注，42岁的男子孙兵竟向天安门城楼毛主席像投掷墨水瓶，造成画像污损。法晚记者上午获悉，东城法院一审以犯寻衅滋事罪，判处孙兵有期徒刑一年二个月。

42-year-old Sun Bing had been sentenced to one year and five months by Haidian Court due to credit card fraud .He was released on February 4th ,2013.

42岁的孙兵曾因信用卡诈骗罪被海淀法院判处有期徒刑一年五个月，2013年1月4日刑满释放。

Dongcheng Procuratorate accused that, Sun Bing poured ink to Mao Zedong picture on Tiananmen Square south of Tiananmen Gatetower at 12’o clock on March 6th ,2014. His behavior caused damage of Mao Zedong picture.

东城检察院指控，2014年3月6日中午12点，孙兵为达到个人目的，在北京市天安门城楼南侧小广场向天安门城楼毛主席像投掷墨水瓶，造成毛主席像污损，现场临时采取清场等措施。

Sun Bing was captured by police first hand.

此后，孙兵被民警当场抓获。

Sun Bing confess his crime at the court opening.

此案开庭时，孙兵表示认罪。

Sun Bing ignored national law and make disturbances in public places and confound social management order,so he committed affray crime,Dongcheng Court said.

东城法院认为，孙兵无视国法，在公共场所起哄闹事，造成公共场所秩序严重混乱，其行为妨害了社会管理秩序，已构成寻衅滋事罪。

Sun Bing was sentenced to term imprisonment previously and he committed crime in five years.So he should be punished as a recidivist according to the law.

孙兵曾因故意犯罪被判处有期徒刑，刑罚执行完毕以后，在五年内再犯应当判处有期徒刑以上刑罚之罪，系累犯，依法应当从重处罚。

All in all,Sun Bing was sentenced to one year and two months for affray crime.

综上，东城法院作出一审判决，以犯寻衅滋事罪判处孙兵有期徒刑一年两个月。
